The Building Board of Appeals is established to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of the adopted Building Code in force at the time of the appeal. This board is appointed by the County Council and consists of members who are qualified by experience and training to pass on matters pertaining to building construction. This board does not meet on a regular basis only as needed.
An application for appeal shall be based on a claim that the true intent of the adopted building code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of the code do not fully apply or an equally good or better form of construction is proposed. The board does not have the authority to waive requirements of the adopted building code.
To request to be heard by the board, an application shall be submitted within 30 days of the decision to be appealed. This application should be complete and should include additional information required to support the appeal and the application fee of $325.00.
