Magistrates are judicial officers that are appointed to four-year terms by the Governor upon the advice and consent of the South Carolina Senate. They serve the county in which they are appointed and exercise county wide jurisdiction. They preside over civil, criminal and traffic cases, issue restraining orders, search and arrest warrants and conduct bond hearings, preliminary hearings, bench and jury trials. They have jurisdiction in civil cases when the amount in controversy does not exceed $7,500 per side (example: Plaintiff sues for $7500 and Defendant counterclaims for $7500), in traffic and criminal cases that typically carry a maximum punishment of 30 days in jail (although some offenses may carry up to 6 months) and Landlord-Tenant cases with no limit on the dollar amount involved.There are five Magistrate’s Courts in York County.

The county is divided into five townships and there is one Judge for each of the townships. The Townships are as follows (with office location in parenthesis): Bethel-King’s Mountain Township (Clover), Broad River-Bullocks Creek (Hickory Grove), Catawba-Ebenezer (Rock Hill), Fort Mill (Fort Mill), York-Bethesda (York). All offices are open Monday through Friday from 8 a.m. until 5 p.m. except for the offices in Hickory Grove and Rock Hill. The hours in Hickory Grove are 9 a.m. until 5 p.m. Tuesday thru Friday. The hours in Rock Hill are 7:00 a.m. until 5:30 p.m. Monday through Friday.

In addition to the Magistrate court’s located in the Townships, there is the York County Bond Court. The Bond Court is located at the Moss Justice Center inside of the York County Detention Center. The Bond Court is open for business 365 days a year for 24 hours a day and a Judge is on duty at all times. However, the Bond Court Judge cannot issue warrants or legal papers on a crime that has just been committed unless the Magistrate has an incident report from the investigating police department. If you need to see a Magistrate pertaining to a criminal offense which occurred in York County, you must have the incident report number which you have received from the Sheriff's Office. After you file a report with the Sheriff's Office, contact the Magistrate’s Court in the township in which the offense occurred, requesting issuance of a criminal arrest warrant. If you are inquiring about a civil matter, then you must contact the Magistrate’s Court of the township in which the person resides
