Probate Court handles various legal issues, most commonly marriage licenses, wills and the estates of deceased people.

The Probate Court is located in the old Belk Building diagonally across the street from the York County Courthouse in downtown York. It is headed by an elected Probate Judge who serves a four-year term.

Listed below are the major functions of the Probate Court:

Marriage License:
Marriage License may be applied for at the Probate Court between the hours of 8:00AM - 5:00PM, Monday through Friday. The Court does not perform marriage ceremonies. The license can only be used in the State of South Carolina. Please see the FAQs for more information.

Estate:
The Probate Court handles all estates for York County residents. Please contact our office during business hours for additional information regarding estates.

Guardianship / Conservatorship:
The Probate Court handles the appointment of Guardians / Conservators for incapacitated adults, convservators for minors and wrongful death settlements and trust matters. Please contact our office during business hours for additional information regarding guardianships and conservatorships.

Commitments:
The Probate Court handles involuntary commitments for chemical dependency and mental illness. Please contact our office during business hours for additional information regarding commitments.
