**Warning**
As the result of recent storm damage across the York County area we are experiencing many unlicensed and unqualified contractor type individuals entering the York County area looking to contract your storm damages such as roofing. Although York County doesn’t require a building permit for this type of work these individuals are required by the South Carolina Labor , License and Regulations to have a valid South Carolina contractor’s license to perform work in the state.
If you have any questions regarding whether a person is licensed please contact the York County Building and Codes Division for information regarding the licensing or other required permit for the repair of storm damaged property.
Functions
The Building and Codes division is charged with enforcing South Carolina adopted internationally recognized construction standards for all new construction, renovations, and additions. Inspection personnel are certified by the State of South Carolina Building Code Council and strive to provide efficient and responsive service to the citizens of York County to ensure that contractors performing work in York County are properly licensed and qualified to perform in South Carolina. York County does not require a “business license” to contract work in the unincorporated areas of the County.
Responsibilities

Administer the inspection and permitting program.

Interpret, direct, and coordinate the enforcement of the International Code series.

Assist outlying governing agencies with inspection and plan review.

Provide administrative services to the Building Board of Appeals.

Ensure that contractors are properly licensed in the State of South Carolina to perform work.

Copies of the International Code series can be purchased through the York Technical College bookstore at 452 South Anderson Road, Rock Hill, SC. You may also view the information at the Public Library in the reference section.
Licenses may be obtained from the State of South Carolina by contacting the S.C. Department of Labor, Licensing and Regulation. They can be reached by telephone at (803) 896-4300 or to visit their website, click here.
Yes, if you or your immediate family members are performing the work and if you will live in your home for at least two years after the work is completed.
Other than the homeowner or his immediate family member, only state-licensed contractors are permitted to work on your property. To find out more from SC Department of Labor, Licensing and Regulation, click here.
Permits are not generally required for minor, non-structural repairs. To determine if a permit will be required, please contact the York County Building and Codes division by e-mailing customer service at customerservice@yorkcountygov.com.
Call the Building & Codes Division at (803) 909-7200. Inspections must be called in 24 hours ahead of time. You will need to provide your permit number and the type of inspection needed. Please be sure all work has been completed before requesting an inspection. The inspector must have safe access in order to enter and perform an inspection.
- If the building is less than 120sq/ft and not on a permanent foundation, you will need a Zoning Compliance to regulate the set-back requirements for your property, you may reach the zoning division at (803) 909-7235 or by e-mail, peggy.hill@yorkcountygov.com.
- If the building is greater than 120sq/ft then you will need a building permit and the building construction shall comply with the most current building code being enforced.

No, however each trade shall be properly licensed in South Carolina and listed on the General Contractors Permit Application with the state license number listed.

A Registered Land Surveyor is required to fill out a FEMA approved Elevation Certificate which must be submitted to Environmental Compliance, which is a division of the Engineering Department in York. They can be reached at (803)684-8571 or jennifer.culver@yorkcountygov.com.
If the property has been repossessed by the Lender, they will need to supply the Building and Codes Division with the Foreclosure documents. Also, they will need to provide us with the SC Licensed Contractor that will be completing the project. The Contractor will have to come into the office and do a Change of Contractor. There is a $30 transfer fee and once that has been completed we will schedule a "Field Inspection" to properly determine the scope of work that has been done (which the previous builder would be responsible for) and what will be needed to finish the project (which the new contractor of record would assume responsibility for). It is possible for an Owner Builder to take over a project as well; it would follow the same procedure mentioned above, except the Owner would take the place of the Contractor and the Bank.
South Carolina Board of Architectural Examiners requires the following:
SECTION 40-3-290. Exceptions from coverage of chapter.
(A) Nothing in this chapter prohibits a general contractor or a home builder from the preparation and use of details and shop drawings, assembly or erection drawings, or graphic descriptions used to detail or illustrate a portion of the work required to construct the project in accordance with the plans and specifications prepared or to be prepared under the requirements of this chapter.
(B) Nothing in this chapter prevents or affects the practice of any other legally recognized profession.
(C) If the drawings and specifications are signed by the authors with the true title of their occupations, this chapter does not apply to the preparations of plans and specifications for:
(1) a building which is to be used for farm purposes only;
(2) a building less than three stories high and containing fewer than five thousand square feet of total floor area except buildings of assembly, institutional, educational, and hazardous occupancies as defined by the Standard Building Code, regardless of area;
(3) a detached single-family or two-family dwelling, as defined in Group R3 of the Standard Building Code, regardless of size, with each unit having a grade level exit and sheds, storage buildings, and garages incidental to the dwelling;
(4) alterations to a building to which this chapter does not apply, if the alterations do not increase the areas and capacities beyond the limits of this chapter or affect the structural safety of the building.
SECTION 40-3-320. Issuance of building permits.
The building official or other authority charged with the responsibility of issuing building or other similar permits of any county, municipality, or other subdivision, before issuing the permit, must be in possession of a sealed set of plans and specifications for which the seal of a registered architect is required and to verify that the architect who sealed the architectural plans and specifications is an architect registered in South Carolina.
